These Terms of Sale (“Terms of Sale”) apply to all purchases made through www.fmsautoperformance.com (the “Website”) and form a binding agreement between you (“Customer”) and FMS Auto Performance, a California-based business (“Company,” “we,” “us,” or “our”).

By placing an order, you agree to these Terms of Sale in addition to our Terms of Use, Privacy Policy, Shipping Policy, and Returns & Refunds Policy.

ORDER ACCEPTANCE

All orders are subject to acceptance by FMS Auto Performance.

Order confirmation does not guarantee acceptance
We reserve the right to cancel or refuse any order due to inventory issues, pricing errors, supplier restrictions, suspected fraud, or legal compliance requirements

If payment has been processed for a canceled order, a refund will be issued.

PRICING & PAYMENT

Prices are subject to change without notice
Taxes, shipping, and fees are calculated at checkout
Payment authorization occurs at the time of purchase

We reserve the right to correct pricing errors and cancel affected orders.

TITLE & RISK OF LOSS

Ownership of products transfers to the customer upon shipment.

Risk of loss passes to the customer once the shipment is handed to the carrier.

PRODUCT USE & LEGAL COMPLIANCE

Many products sold are intended for off-road or competition use only.

The customer is solely responsible for:

Vehicle compatibility
Emissions and CARB compliance
Legal use on public roads

FMS Auto Performance makes no guarantees regarding legality, emissions compliance, or performance results unless explicitly stated.

We do not provide mechanical, emissions, or legal advice.

We are not responsible for labor costs, vehicle damage, or downtime

RETURNS & CANCELLATIONS

Returns, refunds, and cancellations are governed exclusively by our Returns & Refunds Policy.

Special order items may not be canceled once placed.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, FMS Auto Performance shall not be liable for indirect, incidental, or consequential damages.

Our total liability shall not exceed the amount paid for the product giving rise to the claim.

GOVERNING LAW

These Terms of Sale are governed by the laws of the State of California, without regard to conflict of law principles.
